Common Sinister Diesel Misconceptions
Sinister Diesel is suing over the color blue
Sinister Diesel is not suing over the color blue. We do possess a legal trademark for the color blue in the aftermarket diesel parts industry, but we have never taken legal action with it. This leads us into our next question
Why did Sinister Diesel trademark the color blue?
When you think of brown shipping trucks, what company comes to mind? How about green tractors? Companies like UPS (Brown), John Deere (Green), Target (Red), and Tiffany & Co. (Blue) have successfully trademarked colors to create strong brand recognition. While this can be a powerful marketing tool, it also comes with significant challenges.
As the influx of Chinese-made parts increased, so did our volume of customer service issues related to counterfeit products. Our Customer Service team is inundated daily with complaints about products we never manufactured. These counterfeit items all use our brand's distinctive color and even photoshopped version of our own photos with logos removed. Before we even trademarked the color blue, Sinister Diesel was already recognized in the Diesel Industry for the color. This is the key ingredient to being able to establish a color as a trademark. A company can't just apply for the color, we have to put together a case regarding brand identity and the color that signifies that.
To combat this influx in Customer Service, we utilize our trademark rights to remove 10-20 Chinese knock-off listings each week. Despite our efforts, we've taken down nearly 500 listings of cheap, inferior knock-offs to date. These counterfeit products cause numerous problems for unsuspecting customers, from splitting welds and deteriorating hoses that leak. Many customers mistakenly believe these knock-offs are our products.
